1. Acceptance of Terms
Welcome to Staycating.com, owned and operated by Staycating, LLC, a Tennessee limited-liability company based in Knoxville.
By accessing or using our website, booking a property, submitting information, or engaging with any of our services, you agree to these Terms of Service (“Terms”) and our Privacy Policy.
If you do not agree, please do not use our site or services.
2. Our Services
Staycating.com (“the Site”) offers real-estate, property-management, short-term rental, coaching, consulting, and hospitality-marketing services in East Tennessee and beyond.
Our ecosystem includes property listings, management systems, vendor connections, concierge support, and travel content (“Services”).
We may also provide links or integrations with platforms such as Airbnb, Vrbo, Stripe, and GoHighLevel. Those third-party sites have separate terms and privacy practices.
3. Eligibility
You must be at least 18 years old to use our Site or book with us.
If you access our Services on behalf of a business or organization, you confirm you are authorized to do so.
4. Booking and Guest Responsibilities
When booking a Staycating property:
- You agree to provide accurate guest, payment, and contact information.
- You acknowledge that properties listed on Staycating.com are short-term rental units under the Tennessee Short-Term Rental Unit Act (T.C.A. §13-7-601 et seq.).
- Staycating, LLC complies with local permits, occupancy standards, tax collection, and safety requirements.
- Guests must follow property-specific house rules, including occupancy limits, parking, noise, smoking, and pet policies.
- You’re responsible for any damage or violation caused during your stay and authorize Staycating, LLC to charge repair or additional cleaning fees when applicable.
Failure to comply may result in immediate termination of the stay without refund and potential legal liability.
5. Payment and Taxes
Payments may be processed through Melio, Stripe, or other approved methods.
All bookings are subject to applicable Hotel Occupancy Tax (Knox County), Local Sales and Use Tax, and Tennessee Sales and Use Tax.
Taxes are collected and remitted in accordance with state and local law.
Invoices will clearly show rent, cleaning fees, deposits, and taxes.
Refunds and cancellations follow the terms on each property listing.
6. Acceptable Use
You agree not to:
- Misuse the Site for fraudulent or illegal activity.
- Post or transmit defamatory, offensive, or infringing content.
- Interfere with website functionality, data, or systems.
- Copy, scrape, or resell our content or branding without written permission.
7. Intellectual Property
All Staycating names, logos, text, designs, and systems (including Staycating 360, Staycating 247, Guestologix, and MillionDollarSTR brands) are trademarks and property of Staycating, LLC.
You may not reproduce or distribute our materials without permission.
8. Third-Party Services
We may feature or link to third-party providers (payment processors, analytics tools, booking engines, vendors).
Staycating, LLC is not responsible for their content, policies, or actions.
Your use of third-party tools is at your discretion and risk.
9. Disclaimer of Warranties
The Site and Services are provided “as is” and “as available.”
We make no warranties, express or implied, including merchantability or fitness for a particular purpose.
We cannot guarantee uninterrupted access, error-free operation, or accuracy of property information.
10. Limitation of Liability
To the fullest extent allowed by law, Staycating, LLC and its officers, employees, affiliates, or agents are not liable for indirect, incidental, special, or consequential damages arising from use of our Site or Services.
Our total liability for any claim shall not exceed the amount you paid to us for the booking or $100 — whichever is greater.
11. Indemnification
You agree to indemnify and hold harmless Staycating, LLC, its affiliates, employees, and partners from any loss, claim, or expense (including attorney fees) arising from your use of our Site or Services or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the Site or Services at any time for any reason — including misuse, fraud, or breach of these Terms.
13. Governing Law and Venue
These Terms shall be governed by the laws of the State of Tennessee.
All disputes shall be heard in the state or federal courts of Knoxville, Tennessee.
You consent to this jurisdiction and venue.
14. Changes to Terms
We may update these Terms from time to time. Updated versions will be posted here with a new “Last Updated” date.
Your continued use of the Site after changes means you accept the revised Terms.
